วันที่ 18 ธันวาคม 2533 สมัชชาใหญ่แห่งสหประชาชาติ ได้ยอมรับอนุสัญญาว่าด้วยการคุ้มครองสิทธิของแรงงานข้ามชาติและสมาชิกในครอบครัว จึงได้ประกาศให้ วันที่ 18 ธันวาคม ของทุกปีเป็นวันแรงงานข้ามชาติสากล (International Migrants Day)
แรงงานข้ามชาติ คือ การโยกย้ายแรงงานจากประเทศหนึ่งไปสู่ประเทศหนึ่ง เป็นปรากฎการณ์เชิงบวกที่จะพัฒนาประเทศทั้งประเทศต้นทาง และประเทศปลายทาง โดยประเทศเหล่านั้นจะต้องมีนโยบายชัดเจนถึงการคุ้มครองสิทธิพื้นฐาน และเสรีภาพของแรงงานข้ามชาติเหล่านั้น เพื่อให้เข้าถึงสิทธิประโยชน์อย่างครบถ้วน เพราะแรงงานข้ามชาติเหล่านั้นเปรียบเสมือนสายป่านที่จะเสริมสร้างความร่วมมือระหว่างประเทศ ทั้งระดับภูมิภาคและระดับโลกให้มีความกระชับมากยิ่งขึ้น
ในฮ่องกง เมื่อมองถึงแรงงานข้ามชาติที่มีจำนวนมากที่สุด ก็คือ แรงงานอาชีพผู้ช่วยแม่บ้านต่างชาติฮ่องกง กรมตรวจคนเข้าเมืองฮ่องกงใช้คำภาษาอังกฤษว่า Foreign Domestic Helper แต่ตัวผู้ใช้แรงงานมักจะเรียกตนเองว่า ผู้ใช้แรงงานบ้าน “Foreign Domestic Worker” เพราะถือว่าตนคือแรงงาน ทำงานยิ่งกว่าแรงงานเสียอีก อนุสัญญาที่บัญญัติออกมาเพื่อใช้คุ้มครองแรงงานข้ามชาตินั้น เป็นเพียงแค่ตัวหนังสือ แต่ในทางปฏิบัตินั้นกลับเด่นชัดในเรื่องของการละเมิดสิทธิ ความไม่เท่าเทียมกัน มีการเลือกปฏิบัติอย่างชัดเจน ดังนั้น จึงไม่น่าแปลกใจว่า ในวันแรงงานข้ามชาติสากลนั้น แรงงานผู้ช่วยแม่บ้าน ซึ่งประกอบไปด้วย ชาวอินโดนีเซีย ฟิลิปปินส์ ไทย เนปาล ศรีลังกา อินเดีย ฯลฯ รวมตัวกันภายใต้ชื่อองค์กรต่างๆ เช่น Federation of Asian Domestic Workers' Unions in HK, กลุ่ม Asian Migrantห Coordinating Body-HK, กลุ่ม Coalition for Migrants' Rights จะออกมาเดินขบวน และยื่นข้อเรียกร้องต่อรัฐบาลฮ่องกง ซึ่งในปี 2555 นี้ ข้อเรียกร้องที่ถือเป็นไฮไลท์ที่สุดก็คือ การเรียกร้องให้รัฐบาลฮ่องกงผลักดันให้รัฐบาลจีนลงนามให้สัตยาบันอนุสัญญาองค์กรแรงงานระหว่างประเทศฉบับที่ 189 ว่าด้วยงานที่มีคุณค่าสำหรับผู้ใช้แรงงานในบ้าน ยกเลิกกฎเหล็กอยู่อาศัย 2 สัปดาห์หลังจากยกเลิกสัญญาจ้าง มีกฎหมายกำหนดชั่วโมงการทำงาน ลงโทษบริษัทจัดหางานที่เก็บค่าบริการสูงเกินกฎหมายกำหนด และคุ้มครองหลักประกันสังคมให้กับผู้ใช้แรงงานในบ้าน อนึ่ง เนื่องจากในฮ่องกง ส่วนใหญ่แรงงานผู้ช่วยแม่บ้านฮ่องกง จะได้หยุดในวันอาทิตย์ ดังนั้นการเดินขบวน ยื่นข้อเรียกร้องต่างๆ จึงเลือกเอาวันอาทิตย์ที่ 16 ธันวาคม 2555

On the occasion of the International Migrants Day, foreign domestic workers (FDWs) and local working peoples, advocates and supporters will march to the streets of Hong Kong to demand an end to exploitation, abuse and modern-day slavery of migrants domestic workers in Hong Kong both by their respective governments and of the HKSAR government.
Specifically, foreign domestic workers’ associations, unions, alliances and federations from the Philippines, Indonesia, Nepal, Thailand and Sri Lanka under the banner of the Asian Migrants’ Coordinating Body (AMCB-IMA), the largest alliance of FDW groups in territory – will carry the following demands:
1. Legislate working hours regulation for local and migrant workers in HK
2. Abolish the discriminatory “Two-week Rule” policy of the HKSAR government
3. Make live-in arrangement for FDWs optional and not mandatory
4. Increase of FDWs’ wage and the inclusion in the statutory minimum wage law.
5. Social security protection for local and migrant domestic workers in Hong Kong
6. Investigate and prosecute employment agencies for their excessive and illegal fees.
7. Allow direct hiring for FDWs in Hong Kong.
8. Lift the immigration ban on Nepalese workers in Hong Kong
9. No to increase in government fees by migrant-sending countries
10. China’s Ratification of the ILO Domestic Workers Convention (C189) and its application to Hong Kong
